Terms of Service for Whispr

1. Acceptance of Terms

By using Whispr, you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Eligibility

Whispr is intended for users aged 13 and older. By creating an account, you confirm that you meet this age requirement.

3. Account Responsibilities

• You agree to maintain the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• You must not share session pairing codes with unintended recipients.
• You are responsible for ensuring you have the legal right to communicate with your session partner.

4. Acceptable Use

You agree to use Whispr responsibly and lawfully:

You must NOT use Whispr to:

• Transmit illegal, threatening, harassing, or abusive content
• Record conversations without the consent of all participants where required by law
• Impersonate another person or misrepresent your identity
• Interfere with or disrupt the app's infrastructure or other users' connections
• Attempt to intercept or eavesdrop on other users' communications
• Use the app for any commercial purpose without written permission

You are solely responsible for complying with all applicable laws regarding voice communication and recording in your jurisdiction.

4.a Voice Communication Terms

Whispr enables real-time voice communication between paired devices:

• All voice communication is transmitted directly between devices (peer-to-peer)
• Whispr does not monitor, record, or store voice communications
• You are responsible for obtaining consent from your communication partner before recording any conversation
• Voice quality and connection reliability depend on your network conditions, device capabilities, and proximity (for direct mode)
• Whispr is not a replacement for emergency communication services

5. Premium Subscriptions

Whispr offers an optional premium subscription (Whispr+) that provides enhanced features:

• Billing is processed through Apple App Store or Google Play Store
• Free trial (if offered) converts to a paid subscription unless canceled before the trial ends
• Cancellation takes effect at the end of the current billing period
• Refunds are handled by Apple or Google according to their respective refund policies
• Premium features include unlimited-range cloud communication and group channels

6. Intellectual Property

Whispr and its content are protected by intellectual property rights:

Whispr Ownership:

• The Whispr name, logo, and branding are trademarks of MERAF Digital Solutions
• App design, graphics, animations, and user interface are proprietary
• All source code, algorithms, and technical implementations are protected

You may not copy, modify, distribute, or create derivative works from Whispr's intellectual property without express written permission.

7. Usage Restrictions

You may not:

• Reverse engineer, decompile, or tamper with the app's backend or security features
• Use automated systems, bots, or scripts to interact with the app
• Attempt to bypass security measures, subscription restrictions, or access controls
• Redistribute, sublicense, or resell access to the app or its features
• Use the app in a way that could damage, disable, or impair the service

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

You may delete your account at any time through the app settings. Upon deletion, Firebase Authentication credentials are deleted after 30 days and all Firestore data is deleted or anonymized after 90 days, as described in our Privacy Policy.

9. Indemnification

You agree to indemnify and hold harmless Whispr, MERAF Digital Solutions, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use or misuse of the app
• Voice communications you transmit or record using the app
• Your violation of these Terms of Service
• Your violation of any third-party rights or applicable laws
• Unauthorized use of your account due to your failure to maintain security

This indemnification obligation survives termination of your account and these Terms of Service.

10. Limitation of Liability

While we strive to provide a secure and reliable service, Whispr cannot guarantee uninterrupted or error-free access at all times.

To the maximum extent permitted by law:

• Whispr is provided 'as is' without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months
• We are not responsible for connection quality, latency, or interruptions caused by network conditions or device limitations

Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.

11. Dispute Resolution

We encourage you to contact us first to resolve any disputes:

Resolution Process:

• Contact us at hello@whisprtalk.com with details of your concern
• We will attempt to resolve disputes informally within 30 days
• If informal resolution fails, disputes will be resolved through binding arbitration
• Class action lawsuits and class-wide arbitrations are waived where permitted by law

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction where MERAF Digital Solutions operates, without regard to conflict of law provisions.

13. Modifications

We may update these Terms from time to time. We will notify users of material changes through the app or via email. Continued use of the app after changes means you accept the new terms. If you disagree with changes, you may delete your account.
